Dear Sir
Find attached the copy of the PIL titled as “Sandeep Bhardwaj V Ministry of Urban Development & Housing & Ors” with W.P (C) No.4852/2021 to seek refund of Conversion & Parking Charges collected by the Municipal Corporation(s) since the same has been diverted for payment of Salary and establishment expenses rather the same being spent on providing parking facilities,augmenting the infrastructure ie sanitation ,roads & improving the quality of environment ,the purpose for which these charges were levied.
To hold notification dated 29/06/2018 as ultra vires since it seeks payment of Conversion Charges in lump sum mode rather than annual payment mode as possible in the previous notification ,the same being violative of Article 14 of the constitution .
The PIL was dismissed by the Hon’ble Court holding that the grounds may be considered in accordance with law and public policy in an individual petition rather than in the form of Public Interest Litigation.
