Rajiv Kumar Moudgil, the Congress Candidate from ward no 11, Chandigarh Municipal Congress has filed a complaint against Shri Anup Gupta, the BJP Candidate and the elected councilor from the same ward, before Senior Superintendent of Police Chandigarh, yesterday.
Moudgil alleged in the complaint that while submitting his Nomination papers as a BJP candidate from ward no 11 in December 2021 Shri Gupta filed an untrue, false affidavit with the State Election with an intent to cheat and mislead the voters of Chandigarh.
By filing a false affidavit Shri Gupta suppressed the true and correct information from the voters and has therefore committed an offence under sections 171G, 177, 181, 420, 467, 468 and 471 of IPC besides under sections 125-A of Representation of Peoples Act, 1951 and therefore has made himself liable to be prosecuted under the aforementioned provisions of the Law, Moudgil further stated.
Elaborating further, Moudgil stated that Mr. Gupta is an Advocate duly enrolled as such with Punjab and Haryana Bar Council, Chandigarh since 2007. He has been allotted Chamber no. 272 in District Courts Sector 43, Chandigarh also. Maudgil also stated that as per the rules of the Bar Council, Gupta filed an affidavit in Punjab and Haryana Bar Council before enrolling himself as an Advocate to the effect that he would not indulge in any other business or employment other than legal practice as an advocate. However, Shri Gupta lied in his affidavit by stating categorically that he was only a Businessman and showed an annual income of Rs 80,33,100 from his business.
In his complaint, Moudgil urged the SSP to register an FIR against shri Gupta and take appropriate legal action against him in view of the offence committed by him.
