ORDER UNDER SECTION 144 Cr.P.C.

Whereas, the Lok Sabha Election -2024 is scheduled to be held on 01.06.2024 in Chandigarh Parliamentary Constituency. According to the provision made under Section 126 of the Representation of the People Act, 1951, in the period of 48 hours ending with the hour fixed for the close of poll, the campaign will come to an end.

During the course of campaign the political parties mobilize their supporters, including from outside the constituency of poll, in order to bolster that campaign. In view of the fact that on the closure of campaign period, no campaign can take place within the constituency, presence of political functionaries/party workers/procession functionaries/campaign functionaries etc. who have been brought from outside the constituency and who are not voters of the constituency, should not continue to remain present in the constituency as their continued presence after campaign ends may undermine the atmosphere for free and fair poll.

Therefore, the supporters, relatives and sympathizers of the contesting candidates who have come to campaign in favour of the candidates earlier, on 30.5.2024 in the evening are required to leave the candidate’s constituency after campaigning/campaign is over from 06:00 P.M.

The presence of such persons at the time of voting in constituency of candidates may affect the peaceful and proper voting process.

Keeping the above provisions in mind, it has become necessary for such persons and supporters to leave, if they are not voters of the Chandigarh Parliamentary Constituency.

Now therefore,Sh., Vinay Pratap Singh, I.A.S., District Magistrate, U.T., Chandigarh, in exercise of the power vested u/s 144 of Cr.P.C., do hereby order as a measure of emergency that the outsiders, relatives and supporters (if they are not voters of Chandigarh) of the contesting candidates, who have come to campaign in favour of their candidates in Chandigarh immediately leave the city on 30.05.2024 at 08:00 PM.

To ensure the compliance of this order, the police may take all necessary measures which may include

a) Checking of Kalian mandapams/community halls etc., where such people are kept housed and find out whether the outsiders have been accommodated in these premises.

b) Verification of lodges and guesthouses to keep a track of the list of occupants.

c) Set up check-posts in the constituency borders and track the vehicular movement from outside the constituency,

d) Verify the identity of the people/group of people in order to find out whether they are voters or not and establish their identity.

This order shall come into force from 06:00 pm on 30.05.2024 and shall be effective up to and including 01.06.2024,

In view of the emergent nature of the order it is being issued ex-parte and is addressed to the public in general. Any breach of this order would invite action under section 188 of the Indian Penal Code.
